Consumer Bankruptcy Attorney (Chapter 7 and 13)(Florida Remote) | Full Time - Candidates out of state will not be considered for the opportunity. An established Florida consumer bankruptcy practice is hiring an attorney to represent individuals in Chapter 7 and Chapter 13 cases. You will own your client relationships and caseload from the first consultation through discharge or plan completion. Paralegals prepare the filings and a separate team collects client documents, so your time goes to advising clients, reviewing the work and appearing in court. What You'll Actually Be Doing
- Meet with clients who are behind on credit cards, medical bills, car loans and mortgages, and who often face lawsuits, garnishments or foreclosure
- Decide between Chapter 7 and Chapter 13, run the means test analysis, and explain exemptions and what happens to their home, car and income
- Review petitions, schedules, statements of financial affairs and means tests against client documents, then sign and file
- File emergency petitions to stop a sale or garnishment, and handle amendments and corrections
- Attend 341 meetings and prepare clients for the trustee's questions
- Respond to trustee document requests, objections and motions to dismiss
- Appear at hearings on stay violations, reaffirmation agreements and discharge issues
- Structure Chapter 13 repayment plans and handle confirmation objections, motions for relief from stay, mortgage arrears and plan modifications
- File motions to value, avoid liens and incur debt
- Supervise the paralegals on your files and keep a high volume caseload on deadline
What We're Looking For:
- Active member in good standing of The Florida Bar
- Consumer Chapter 7 and Chapter 13 experience representing debtors
- Admitted to the Southern or Middle District of Florida bankruptcy courts, or able to be admitted
- Working knowledge of CM/ECF, PACER and bankruptcy petition software
- Clear communicator with stressed clients and sound judgment
- Able to work independently in a remote setting
- Willingness to learn. Attitude counts as much as years of experience. Compensation
$100,000 to $125,000 base salary plus bonus, depending on experience.
